Blueline-hit doctor gets Rs 36 lakh

New Delhi: A doctor who suffered partial disability in one of his legs after being hit by a recklessly-driven blueline bus nine years ago, has been awarded compensation of Rs 36 lakh by a Motor Accident Claim Tribunal.

Ghosh, a surgeon, was riding his scooter on November 19, 1997, when he was hit by a bus coming from the wrong side of the road near Mota Singh Marg. He suffered multiple fractures in his right leg.

‘‘It is well established that Prasun Ghosh (the doctor) sustained injuries on account of negligent driving by the driver of the bus,’’ said Additional Sessions Judge Gurdeep Singh in a recent order. In petition filed through counsel Yoginder Vasisht, Ghosh had contended before the Tribunal that he had to undergo surgeries for a long time because of the accident. In a similar case, another MACT judge awarded a compensation of Rs 21 lakh to the kin of a 31-year-old IAS officer who died after being run over by a tanker in 2002.

Awarding the compensation to the wife of deceased Nirmal Wadhwani, MACT presiding officer V K Maheshwari held New India Assurance Company (the insurer of the vehicle), vehicle owners Ammonia Supply Co and driver Phool Singh jointly liable to pay the amount. The court ruled that a government servant’s salary increases every year due to annual increment and twice every year due to revision of dearness allowance. Besides, a government servant is entitled to at least two promotions in his career on account of the Assured Career Promotion Scheme.

The court also took note of the submission of the petitioner that Wadhwani was a bright young officer with graduate and postgraduate degrees from IIT, who became an IAS officer in 1993 at the age of and could have been promoted to the rank of cabinet secretary.
